Refund Policy

When you place an order with us totaling over €20, shipping is free within the Netherlands; & for Belgium, shipping is free on& 

orders over €50. 

Orders paid for and finalized on business days before 4:00 PM will be shipped the same day.MWPshop.com We ship your order immediately, and it usually arrives the next day. However, our shipping partner may take longer to deliver.

All our products display current stock levels, so you’ll never face unexpected surprises. If stock levels differ from those shown on the webshop, we’ll contact you as soon as possible to find a suitable solution. 

Definitions

1. MWPshop.com : MWPshop.com, : Based in Biezenmortel, Chamber of Commerce no. 72928891.
2. Customer: the party with whom MWPshop.coman agreement has been entered into.
3. Parties: MWPshop.comthe company and the customer together.
4. Consumer: a customer who is also an individual and who acts in a private capacity.

Applicability of Return and Refund Policies

1. These return and refund policies apply to all work, orders, agreements, and deliveries of services or products by or on behalf of MWPshop.com.
2. the Parties. The Parties may only deviate from these return and refund policies if they have expressly agreed to do so in writing.
3. The Parties expressly exclude the applicability of any additional and/or deviating general and/or delivery terms and conditions of the customer or of third parties.

Consequences of Late Payment

1. If the customer fails to pay within the agreed term, [the company] isMWPshop.comentitled to charge statutory interest of 2% per month for non-commercial transactions, effective from the day the customer is in default, with any partial month being counted as a full month.
2. If the customer is in default, they are also liable for extrajudicial collection costs and any damages owed to MWPshop.com. 
3. [Company Name]. The collection costs are calculated in accordance with the Extrajudicial Collection Costs Decree.  
4. If the customer fails to pay on time, [Company Name] MWPshop.com  may suspend its obligations until the customer has fulfilled their payment obligation.  
5. In the event of liquidation, bankruptcy, seizure, or suspension of payments on the part of the customer, the MWPshop.com customer’s outstanding debts become  MWPshop.com  immediately due and payable. 
6.   MWPshop.com , If the customer refuses to cooperate in the performance of the agreement MWPshop.com, , the customer remains obligated to MWPshop.com  pay the full agreed price MWPshop.com  .  

Right of reclamation  

1. : As soon as the customer is in default, the MWPshop.com  supplier is   MWPshop.com  entitled to invoke the right of reclamation with respect to the unpaid products delivered to the customer.
2. MWPshop.com The supplier invokes the right of reclamation by means of a written or electronic notice.
3. As soon as the customer has been notified of the exercise of the right of complaint, the customer must immediately return the products to which this right applies, unless  MWPshop.com , the parties agree otherwise.  
4. The costs of retrieving or returning the products are the responsibility of the customer.

Right of Withdrawal  

1. A consumer may cancel an online purchase during a 30-day cooling-off period without giving a reason, provided that:

• If you exercise your right of withdrawal, the product must be returned to the seller with all accessories supplied and—if reasonably possible—in its original condition and packaging.
  If the product is damaged or the packaging is damaged beyond what is necessary to try the product, we may charge you for the resulting loss in value. Please handle the product with care and ensure it is properly packaged when returning it.
• it is not a product that can spoil quickly, such as food or flowers
• it is not a product that has been custom-made or altered specifically for the consumer
• it is not a product that cannot be returned for hygiene reasons (underwear, swimwear, etc.))
• the product is not a trip, a ticket, a catering service, or a form of leisure activity;
• the product is not a single issue of a magazine or newspaper
• ; it does not involve an urgent repair (or a request for such)

1. . The 30-day cooling-off period referred to in paragraph 1 begins:
• on the day after the consumer has received the last product or part of an order
• as soon as the consumer  has received the first product  in a subscription
• as soon as the consumer has purchased a service for the first time
• as soon as the consumer has confirmed that they will purchase digital content via the internet
2. The consumer may exercise their right of withdrawal by service@mwpshop.com , using the withdrawal form, which MWPshop.com,www.MWPshop.com, can be downloaded from the websiteMWPshop.com,www.MWPshop.com , .
3. The consumer is required to return the product within 30 days of exercising their right of withdrawal;MWPshop.com , failure to do so will result in the loss of that right.  

Reimbursement of shipping costs    

1. If the consumer has exercised their right of withdrawal in a timely manner and, as a resultMWPshop.com, has returned the entire order in a timely mannerMWPshop.com,MWPshop.com any shipping costs paid by the consumer will be MWPshop.comrefunded within 30 days of receipt of the timely and fully returned order. 
2. Delivery costs will only  be  refunded to MWPshop.com  the extent that   MWPshop.com  the entire order is returned.

Reimbursement of Return Costs
If the consumer exercises their right of withdrawal and returns the entire order in a timely manner, the costs of returning the entire order shall be borne by the consumer. 

Right of Suspension Unless
the customer is a consumer, the customer waives the right to suspend the performance of any obligation arising from this agreement.


Retention of title 

1. MWPshop.com : The seller may invoke its right of retention and, in that case, retain the customer’s products until the customer MWPshop.com  has paid all outstanding invoices MWPshop.com  , unless the customer has provided sufficient security for those costs. 
2.  The right of retention also applies under previous agreements under which the customer still owes payments. The seller MWPshop.com.
3. MWPshop.com   is never liable for any damages the customer may incur as a result of the seller exercising its right of retention.

Set-off

Unless the customer is a consumer, the customer waives the right to set  MWPshop.com  off a debt   MWPshop.com against a claim against MWPshop.com .

Retention of Title  

1. MWPshop.com  retains ownership of all delivered products until the customer has fully fulfilled all payment obligations to Retention of MWPshop.com,Title  MWPshop.com , , including claims arising from failure to perform the agreement.
2. Until that time, the seller may   MWPshop.com  at any time invoke its retention of title and reclaim the goods.  
3. Before ownership has been transferred to the customer, the customer may not pledge, sell, dispose of, or otherwise encumber the products. 
4. If  MWPshop.com   th  MWPshop.com e seller  MWPshop.com invokes its retention of title, the agreement shall be deemed terminated, and MWPshop.com the seller shall be MWPshop.com entitled to claim compensation for damages, lost profits, and interest.

Storage  

1. If the customer takes delivery of ordered products later than the agreed delivery date, the risk of any loss of quality rests entirely with the customer.
2. Any additional costs resulting from early or delayed acceptance of products shall be borne entirely by the customer.

Warranty

1. The warranty covering products applies exclusively to defects caused by faulty manufacturing, construction, or materials. 
2. The warranty does not apply in cases of normal wear and tear, or damage resulting from accidents, modifications made to the product, negligence, or improper use by the customer, nor does it 
3. apply 
4. when the cause of the defect cannot be clearly determined.
5. The risk of loss, damage, or theft of the products that are the subject of an agreement between the parties passes to the customer at the moment they are legally and/or physically delivered, or at least come into the possession of the customer or a third party who receives the product on behalf of the customer.

Exchanges  

1. Exchanging purchased items  is only possible if the following conditions are met:
• Exchanges must be made within 7 days of purchase upon presentation of the original invoice
• ; the product must be returned in its original packaging or with the original (price) tags still attached
• ; the product must not have been used
1. . Discounted items, perishable items such as food, custom-made items, or items specially modified for the customer cannot be exchanged.

Indemnification

The customer indemnifies us against MWPshop.com  all claims by third parties related to the  MWPshop.com products and/or services provided. 

Complaints

1. The customer must MWPshop.com  inspect any MWPshop.com delivered product or service as soon as possible for any defects.
2. If a delivered product or service does not meet what the customer could reasonably expect under the agreement, the customer must MWPshop.com  notify the seller as soon as possible, but in any case within one month of discovering the defects.  
3. Consumers must MWPshop.com  notify us of this no later than 2 months after discovering the defects.
4. In doing so, the customer must provide as detailed a description of the defect as possible, so  MWPshop.com that  MWPshop.com we can respond appropriately. 
5. The customer must demonstrate that the complaint relates to an agreement between the parties.
6. If a complaint relates to work currently in progress, this shall in no event result in the  MWPshop.com  Customer MWPshop.com being required to perform work other than that agreed upon.

Notice of Default

1. The customer must provide notice of default in writing to MWPshop.com.
2. It is the customer’s responsibility to ensure that a notice MWPshop.com of default is actually received (in a timely manner). 

Joint and Several Liability of the Customer

If MWPshop.com   an agreement is entered into with multiple customers, each of them is jointly and severally liable for the full amounts they owe under that agreement  MWPshop.com . 

The Company MWPshop.com

1. MWPshop.com is liable only for any damage suffered by the customer if and to the extent that such damage is caused by willful misconduct or gross negligence.
2.  MWPshop.com If Liability is liable for any damage, it is only liable for direct damage arising from or related to the performance of an agreement.
3. MWPshop.com Liability is never liable for indirect damage, such as consequential damage, lost profits, lost savings, or damage to third parties.
4.  MWPshop.com  If liability arises, such liability is limited to the amount paid out under a valid (professional) liability insurance policy; and in the absence of (full) payment by an insurance company of the amount of the damage, liability is limited to the (portion of the) invoice amount to which the liability relates.
5. All images, photos, colors, drawings, and descriptions on the website or in a catalog are merely indicative and approximate only and cannot give rise to compensation and/or (partial) termination of the agreement and/or suspension of any obligation.

Limitation Period

Any right of the customer to compensation  MWPshop.com shall in any event expire 12 months after the event from which the liability directly or indirectly arises. This does not preclude the provisions of Article 6:89 of the Dutch Civil Code.

Right to Termination

1. The customer has the right to terminate the agreement if MWPshop.com  the  MWPshop.com  seller fails to fulfill its obligations through its own fault, unless such failure, given its special nature or minor significance, does not justify termination.  
2.  MWPshop.com  If the performance of the obligations is MWPshop.com permanently or temporarily impossible, termination may only take place after  MWPshop.com  a period of default has elapsed. 
3. MWPshop.com  has the right to terminate the agreement with the customer if the customer fails to fulfill his obligations under the agreement in full or on time, or if MWPshop.com   becomes aware of circumstances that give him good reason to fear that the customer will not be able to properly fulfill his obligations.  

Force Majeure

1. In addition to the provisions of Article 6:75 of the Dutch Civil Code, a failure to  MWPshop.com perform any obligation toward the customer cannot MWPshop.com  be attributed to the customer if it results from a   MWPshop.com situation beyond the customer’s control MWPshop.com   , which wholly or partially prevents the fulfillment of its obligations toward the customer or which makes the fulfillment of its obligations unreasonably difficult  MWPshop.com  .  
2. The force majeure situations referred to in paragraph 1 include, but are not limited to: states of emergency (such as civil war, insurrection, riots, natural disasters, etc.); breaches of contract and force majeure on the part of suppliers, delivery personnel, or other third parties; unexpected power, electricity, internet, computer, and telecommunications outages; computer viruses, strikes, government measures, unforeseen transportation problems, adverse weather conditions, and work stoppages. 
3. If a force majeure situation arises that   MWPshop.com prevents the fulfillment of one or more obligations to the customer, those obligations will be suspended until the custom  MWPshop.com  er can fulfill them again.  
4. Once a force majeure situation has lasted for at least 30 calendar days, either party may terminate the agreement in whole or in part in writing.  
5. MWPshop.com   No compensation or damages are owed in a force majeure situation, even if the party benefits in any way as a result of the force majeure situation.

Amendment of the Agreement  

If, after the conclusion of the agreement, it becomes necessary to amend or supplement its content for the purpose of its performance, the parties shall amend the agreement accordingly in a timely manner and by mutual agreement.

The Supplier

1. MWPshop.com is entitled to amend or supplement these Terms of Delivery. 
2. Minor amendments may be made at any time. 
3. Significant changes to the content MWPshop.com will be discussed with the customer in advance as much as possible.
4. A consumer is entitled to terminate the agreement in the event of a material change to the terms of delivery. 

Assignment of Rights

1. The customer’s rights arising from an agreement between the parties may not be assigned to third parties without the prior written consent of MWPshop.com. 
2. [Company Name]. This provision constitutes a clause with property law effects as referred to in Article 3:83(2) of the Dutch Civil Code.

Consequences of invalidity or voidability

1. If one or more provisions of these terms and conditions of delivery prove to be invalid or voidable, this shall not affect the remaining provisions of these terms and conditions. 
2. In such a case, a provision that is invalid or voidable shall be replaced by a provision that most closely approximates MWPshop.com the intention of the drafter of the terms and conditions on that point.

Governing Law and Jurisdiction

1. These Terms and Conditions of Delivery and any agreement between the parties are governed exclusively by Dutch law. 
2. The Dutch court in the district MWPshop.com where the company is located has exclusive jurisdiction to hear any disputes between the parties, unless otherwise required by mandatory law.

You have the right to cancel your order up to 14 days after receipt without giving a reason. After cancellation, you have another 14 days to return your product. You will then be credited the full order amount, including shipping costs. You are responsible for the costs of returning the item from your home to the online store. These costs amount to approximately €7.25 per package; please consult your carrier’s website for exact rates. 

If you exercise your right of withdrawal, the product must be returned to the seller with all accessories included and—if reasonably possible—in its original condition and packaging. If the product is damaged or the packaging is damaged beyond what is necessary to sell the product, we may charge you for the resulting decrease in the product’s value. Therefore, please handle the product with care and ensure it is properly packaged when returning it.

To exercise this right, please contact us via [contact information]service@mwpshop.com. Wij. We will then refund the order amount within 14 days of receiving your return notification, provided the product has already been returned in good condition.

Applicability of Delivery Terms

1. These delivery terms are effective as of December 1, 2022.
